Constangy will host a breakfast briefing on Thursday, December 6, 2012, in our Atlanta office to discuss the possible effects on Labor & Employment Law after the 2012 Presidential Election.

Discussion will include the effects on:

  • National Labor Relations Board - In the area of traditional labor relations, the expectation during a second Obama term is for more of the same - only on steroids. We anticipate the re-issuance of regulations allowing for "Quickie" or "Ambush" elections. The NLRB will also continue to expand its authority to impact non-union workers and provide more power and leverage to unions in the unionized sector.
  • EEOC & OFCCP - Learn what you can expect from the EEOC and other agencies and their attempts to ferret out "headline" cases by engaging in wide-ranging investigation of individual claims, using "sexual stereotype" theories to extend non-discrimination protection to members of the LGBT community, and seeking reasonable accommodations for women experiencing limitations from normal pregnancies.
  • Supreme Court - Learn about the employment issues that are likely to reach the Supreme Court during the next four years, as the plaintiffs bar seeks to limit previous decisions regarding class action certifications (Wal-Mart v. Dukes) and the enforceability of employment arbitration agreements.

And more, including the effects on OSHA and the Department of Labor!
