Webinar

 | Noon - 1:00 PM ET
The Federal Motor Carrier Safety Administration Clearinghouse went live on January 6. The Clearinghouse is a secure online database that gives employers, the FMCSA, State Driver Licensing Agencies, and state law enforcement personnel real-time access to important information about drug and alcohol program violations of drivers with Commercial Drivers’ Licenses. Making sure your supervisors understand their reporting roles is critical to your compliance and risk reduction strategy.
Webinar Learning Objectives:
  • Drug and alcohol test reporting responsibilities of employers, as contrasted with those of the Medical Review Officer, the Substance Abuse Professional, and the Certified Third-Party Administrator.
  • “Refusal” to take a DOT drug test, and how refusals should be reported in the Clearinghouse.
  • The consequences for a supervisor who makes an inaccurate Clearinghouse report, and how the employer can avoid those consequences.
  • The four supervisor Clearinghouse reporting responsibilities, and how employers can create a systematic process.
  • How a supervisor acquires actual knowledge of a Clearinghouse reportable event.
  • How an employer can avoid DOT fines of $1,100 a day and win its unemployment case by providing due process to the driver before filing a Clearinghouse report with insufficient evidence.
  • How a supervisor can help the employer avoid a discrimination charge when an applicant is not hired based a Clearinghouse report of past drug use.
