Constangy partner Ellen Kearns authored an article for the October 2024 issue of HR.com’s Legal & Compliance Excellence discussing the impact of a recent ruling in a matter related to the U.S. Department of Labor’s (DOL) Minimum Salary Rule.

“On September 11, 2024, a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit issued a decision that could have far-reaching effects on future cases reviewing DOL regulations,” Kearns explained. “In Mayfield v. U.S. Department of Labor, the Fifth Circuit panel held that the DOL did have the authority to use a minimum salary in determining whether an employee qualified for the executive-administrative-professional, or ‘EAP,’ exemption under the FLSA.”

While the minimum salary being challenged in Mayfield has been superseded by the Biden administration’s proposal for an even higher minimum salary, the decision could influence future challenges against DOL wage laws.
