In the News: John MacDonald Publishes Article on Virtual Litigation for New Jersey Law JournalĀ
Constangy partner John MacDonald recently authored an article for the New Jersey Law Journal discussing how Zoom and Teams conferences, mediations, depositions and hearings have become the norm since the COVID pandemic and calling into question whether video lawyering is too ubiquitous today.
John shared an anecdote from a recent visit to the Union County Superior Court in which he recognized that he had not been inside a courthouse in over a year. The judge also noted that he appreciated working in person, and ultimately, the process and outcome of the proceedings were more positive for all involved.
John reflected on this experience and evaluated his use of technology for depositions, settlement conferences, mediations, and hearings, and the pros and cons that come from both virtual and in-person lawyering.
“While litigators shouldn’t operate from any absolute rule of favoring in-person over virtual (and vice versa), it’s important to take a moment to remember the value that each can bring to your matter, depending on the circumstances,” John said. “While remote lawyering can provide convenience and cost savings, certain aspects of your case may benefit from an in-person touch and ultimately benefit your client’s interests.”
