Fabian focuses his practice on representing management in a wide variety of employment issues, and has successfully defended employers in single-plaintiff, multi-plaintiff, and class and collective actions before federal and state courts. Fabian’s experience also includes successfully arbitrating and mediating employment matters from inception to complete dismissal, and helping employers respond to administrative charges brought before federal, state, and local administrative agencies such as the Equal Employment Opportunity Commission, the Florida Commission on Human Relations, and the Miami-Dade Commission on Human Rights.
Fabian has represented clients in the defense of claims brought under the Fair Labor Standards Act; Title VII of the Civil Rights Act of 1964; Family Medical Leave Act; Americans with Disabilities Act; Trade secrets and noncompetition laws; Florida’s Minimum Wage Act; Florida’s Civil Rights Act; and Florida’s Whistle-blower’s Act, as well as various retaliation, tort, and breach of contract claims.
Fabian also provides counseling and training to large and medium sized employers on all aspects of employment law, in both English and Spanish, on topics such as sexual harassment and discrimination, best practices for hiring, discipline, and discharge, wage and hour laws and issues, independent contractor classification issues, and benefits and drawbacks of alternative dispute resolution in the workplace. Fabian has also conducted company-wide audits of employee classifications, compensation practices, and equal employment practices and has reviewed and drafted company handbooks, policies, independent contractor agreements, and alternative dispute resolution policies.
Fabian represents clients in a variety of different sectors including retail, construction, and the sports and entertainment industries.
While in law school, Fabian clerked at a full service law firm, worked as a judicial intern for current Chief United States District Judge of the United States District Court for the District of New Jersey Jose L. Linares, and also for Judge Ivan F. Fernandez of the Florida Third District Court of Appeal. Fabian also served as a legal trainee for the New York City Football Club of Major League Soccer, as a law clerk for the U.S. Department of Homeland Security, and as a legal intern for the Office of the Governor in the state of New Jersey.
Fabian earned his Bachelor of Arts from Rutgers University, where he was a three-year letterwinner for football, and received his Juris Doctor from Rutgers University School of Law, where he was a graduate fellow at the Eagleton Institute of Politics.

Fabian was born in Havana, Cuba, and is a native Spanish speaker. He enjoys spending time with his family, traveling, reading nonfiction, and watching documentaries.
