Almost 30 years after its passage, the Family and Medical Leave Act of 1993 (“FMLA”) continues to be a source of considerable confusion and concern for human resources professionals and supervisors of both public sector employers and private sector businesses employing 50 or more employees. 

In this Breakfast Briefing, presenters Damon Kitchen & Meg Zabijaka will address many of the issues that can arise when eligible employees of covered employers make requests for FMLA leave, including, but not limited to:

  • Under what circumstances can employees use FMLA leave?
  • How must FMLA leave be used and tracked?
  • What notification must an employer provide to an employee once a FMLA-qualifying request for leave has been made?      
  • When, and under what circumstances, can other types of paid leave be substituted for unpaid FMLA leave?
  • What kinds of communications are permissible, or impermissible, for an employer to have with an employee who is taking FMLA leave?
  • Whether and how should disciplinary action may be taken against an employee while on FMLA leave?
  • Should an employer pay an employee’s share of employer-provided insurance benefits while the employee is on FMLA leave in order to avoid a lapse in coverage?
  • What must an employer do if an employee is not fit to return to work after exhausting his/her FMLA leave? 
  • What steps can an employer take to address potential leave abuse?
