Although the Fair Labor Standards Act is one of the nation’s oldest labor laws, it is also one that employers have trouble understanding and frequently violate. When violations occur, employers frequently face: (1) audits by the Wage and Hour Division of the U.S. Department of Labor (“DOL”), and are required to pay civil money penalties to the government, as well as unpaid wages to their employees, or (2) civil lawsuits in which not only monetary damages for unpaid wages can be recovered, but also liquidated damages and attorney’s fees can be awarded to the prevailing employees.
