Regardless of whether you are an elected official, a director, manager, supervisor, or a rank-and-file employee, if you work in the public sector in Florida, you are subject to Florida’s Government in the Sunshine Act and Florida’s Public Records Act.  While these laws were enacted to promote transparency in governmental operations, they can often expose governmental employers and employees alike to potential civil and even criminal liability.  Although the goal and purpose of these laws is relatively simple, the provisions of these laws, the manner in which they operate, and the ways in which they are interpreted by the courts, are quite often complicated, counter-intuitive and confusing.  Additionally, because of new developments in telecommunications technology and social media, these laws are constantly and rapidly changing.

Each and every year, we witness public officials and employees violate these legislative enactments.  While most of these violations are accidental and are devoid of any bad or wrongful intent, it typically makes no difference.  As the old adage states, “ignorance of the law is no excuse . . ,” nor is it a defense to civil liability. 

The good news is that we can help.  There is another old adage that states “knowledge is power.”  That is certainly the case with respect to Florida’s Government in the Sunshine and Public Records Acts.  Please join us for a continental breakfast to discuss the ins-and-outs of these laws, the most recent developments concerning them, and how you can avoid the numerous legal pitfalls associated with these statutes.
