The federal Family and Medical Leave Act (“FMLA”) went into effect on August 5, 1993. Thirty-three years later, U.S. businesses and their human resources professionals are still struggling to comply with that law and its accompanying federal regulations. In this breakfast briefing, we will provide a nuts and bolts overview of the FMLA (i.e., which employers are covered, which employees are eligible, when can FMLA be used, how can FMLA leave be used, and how long does an FMLA leave last?). We will also discuss common FMLA problems that employers often encounter regarding FMLA certification, returning employees to work after the completion of FMLA leave, the continuation of benefits during FMLA leave, communicating with employees while they are on FMLA leave, as well as disciplining and discharging of employees during an FMLA leave of absence, and much, much more.
