Constangy Mourns the Loss of Partner Emeritus, James F. Smith

It is with great sadness that Constangy announces the passing of Partner Emeritus Jim Smith. His contributions to the firm, the legal profession, and his community will be remembered with deep gratitude and respect. We extend our heartfelt condolences to his family, friends, and colleagues.

"Jim was a towering figure in labor and employment law and a mentor to many,” said Neil Wasser, chair of Constangy’s executive committee. “His unwavering commitment to his clients, colleagues, and the legal profession helped shape Constangy into the firm it is today. Beyond his remarkable legal acumen, Jim’s kindness, generosity, and leadership left a lasting impact on all who had the privilege of working with him.”

Jim’s career in labor and employment law spanned decades. He began as a field attorney with the National Labor Relations Board (NLRB) before serving as labor counsel for a major corporation. In 1964, he joined Constangy’s Atlanta office, where he built a reputation for excellence in traditional labor law, particularly in the transportation industry.

Throughout his career, Jim was instrumental in developing several key practice areas at Constangy, including Wage & Hour, Equal Employment, government contract compliance, and Occupational Safety and Health Administration (OSHA) matters. He had a distinguished record of trial and appellate success in cases involving the National Labor Relations Act (NLRA), often going head-to-head with government agencies and labor unions.

A Legacy of Leadership and Service

Jim’s leadership extended beyond the courtroom. He played an integral role in expanding the firm’s practices and served as Management Co-Chair of several American Bar Association (ABA) Labor and Employment Law Committees, including those focused on Fair Labor Standards, Occupational Safety and Health, and Equal Employment Opportunity.

His dedication to the legal community was matched by his commitment to local organizations, including:

  • American Bar Association, Section on Labor and Employment Law
  • North Carolina Bar Association
  • Georgia Bar Association
  • Atlanta Bar Association
  • First Presbyterian Church of Hartwell
  • American Legion

Remembering a Colleague and Friend

Jim was admired by colleagues, clients, and peers for his sharp legal mind, integrity, and unwavering dedication. More than a brilliant attorney, he was a generous mentor who shaped the careers of many.

His legacy will live on in the work and culture of Constangy and the many attorneys he guided throughout his career. We extend our deepest sympathies to his loved ones during this difficult time.
