Arcelia Magaña, San Diego-based labor and employment partner at Constangy, authored an article for The Recorder providing tips on how employers should handle meal period compliance in California. Arcelia noted that late meals still create risk, along with short meal periods or ones that are interrupted.
The issues related to meal period compliance also stem from a lack of monitoring as to whether employees are actually able to take uninterrupted breaks. If timekeeping measures are in place, it is best to periodically review records to identify meal period compliance issues early.
“Employers should regularly audit time records, train supervisors and ensure premium pay is issued when required and at the correct rate of pay,” said Arcelia. “Proactive compliance efforts can significantly reduce the likelihood of costly wage-and-hour litigation and PAGA exposure.”
