In the News: Jim Coleman Shares Guidance on What to Know If DOL Raises the Overtime Salary Floor for Law360
Constangy partner Jim Coleman authored an article for Law360 discussing the U.S. Department of Labor's recent overtime exemption rulemaking, which indicates that there may soon be a move to increase the minimum salary levels required for exemption from the overtime requirements for executive, administrative and professional employees under the Fair Labor Standards Act.
Jim provided insight into the DOL’s recent rulemaking actions, including its recent history under both the Trump and Biden Administrations, and the current minimum salary threshold and current annual minimum compensation level. He also explored possible next steps the DOL could take and why employers should exercise caution. Jim indicated that employers should continue to audit and review their exempt classification criteria to ensure compliance and consider whether state or local law requirements may impose higher or stricter exemption criteria than FLSA.
