In the News: Ken Carlson Discusses Changing Title VII Landscape in North Carolina Lawyers Weekly
Constangy partner Ken Carlson provided insight to North Carolina Lawyers Weekly for its recent article, “Employment lawyers adjust strategy as Title VII landscape shifts.” The article examines how recent developments, including the U.S. Supreme Court’s 2025 decision in Ames v. Ohio Department of Youth Services and evolving Equal Employment Opportunity Commission priorities, are affecting discrimination claims brought by majority-group employees.
Ken noted that discrimination claims brought by majority-group employees appear to have gained greater attention in recent years, while cautioning that available numbers require context.
“It’s my understanding that reverse discrimination claims have noticeably increased in recent years, at least on a national basis,” Ken said. “I’m not sure if that’s more a function of actual lawsuits or EEOC/state administrative agency filings across the country, or rather in terms of heightened EEOC regulatory focus at the federal level.”
The article also examines the significance of the Supreme Court’s Ames decision, which held that Title VII does not impose a heightened evidentiary standard on majority-group plaintiffs. Ken explained that the underlying federal protections are longstanding.
