Punam Rogers, partner in Constangy’s Immigration practice, was quoted in a Part B News article discussing how healthcare providers can address challenges for retaining doctors amid a federal pause on visa renewals affecting many foreign-born physicians.
Punam suggested giving the U.S. Customs and Immigration Service (USCIS) a case they can’t reject. “Build a concrete record of your community’s need: your HPSA or MUA designation, your payer mix, the patient populations you serve, and the real access consequences if that physician is removed — because in some rural communities, a delayed specialist visit means a delayed cancer diagnosis,” she said.
Punam also pressed the importance of digging into the details to have a full understanding of a provider’s status. “What looks like a dead end under one pathway often has a viable route under another,” she said. “The widely reported [Veliz] case is a cautionary example: it was not a J-1 visa expiration, but a Temporary Protected Status (TPS) termination — a legally distinct situation with different options, including adjustment of status through his U.S. citizen spouse. Practices that assume the worst without getting a full legal picture may be giving up on a physician — and a patient panel — they didn’t have to lose.”
