Year after year, voters succeed in legalizing the use and possession of medical marijuana, while employers are left with unanswered questions about how these new laws affect their drug testing practices and drug-free workplace policies. Do we test for marijuana? Can drug tests detect whether someone is under the influence of marijuana at work? What do we tell our MRO? Must we accommodate off-duty marijuana use under our disability laws? Must we engage in the interactive process? On top of all these questions, many employers are also dealing with employees affected by the current opioid crisis in America. During this briefing, we provide an overview of the problems caused by drug use, the Florida and federal laws on the subject, and potential liability for employers. We will also provide some practical advice on how to reduce the risk of a lawsuit while maintaining a drug-free workplace.
