Cory King Speaks on Trends for the Collision Industry to Watch in 2024

On January 17th, Constangy partner Cory King spoke at the Collision Industry Conference on legal trends that may impact auto repairers, insurers, manufacturers, and others in the collision industry in 2024.

One of the most pressing issues for organizations in this industry is the classification of independent contractors. Under the Biden Administration, the U.S. Department of Labor (DOL) issued a new final rule on independent contractors, effective March 11, unless legally challenged. The rule redefines factors determining whether a worker is an employee or independent contractor, potentially affecting benefits like overtime. Cory emphasized the risks of misclassifying employees, including substantial penalties, including attorney fees and backpay.

Another issue highlighted in the program is the evolving stance many states have taken on marijuana users. California and other states have moved to protect marijuana users from discrimination, like race or gender. Cory urged employers that operate in these states to update drug and alcohol policies and reminded the audience that federal legalization of marijuana could bring nationwide changes.
