Cara Crotty, co-chair of Constangy’s EEO/Contractor Compliance, Reporting & Analytics, and DEI Compliance practice groups, authored an article for the Daily Report highlighting that the legal risks associated with disparate impact discrimination claims remain substantial for federal agencies and contractors, regardless of the fact that federal enforcement priorities have changed. 

Cara noted that employers face a more complex environment than ever before, particularly as AI becomes embedded throughout the employment lifecycle, and state and local jurisdictions are increasingly regulating automated employment decision-making. 

In the article, she detailed how federal priorities have changed even though the law has not, provided insight on how statistical analysis remains a critical tool, outlined how AI makes selection decisions harder to defend, clarified that outsourcing technology does not outsource risk and shared guidance on what employers should do now. 

“Employers should keep auditing employment outcomes, particularly when automated tools influence who advances and who does not,” said Cara.
