In The News: Lindsey Stewart Publishes Workers’ Compensation Update in Georgia Defense Lawyer
Constangy attorney Lindsey Stewart authored an article in the Spring 2025 edition of Georgia Defense Lawyer, titled “Workers’ Compensation Case Law Update.” The article reviews recent decisions from the Georgia Court of Appeals impacting key aspects of workers’ compensation litigation, including the scope of the Rycroft defense and justifications for refusal to return to work under the WC-240 process.
Lindsey analyzes McKay v. Inalfa Roof Systems, Inc., in which the Court held that the Rycroft defense does not bar benefits when an employer continues employment despite knowledge of an employee’s false medical history disclosure. She also discusses Taylor v. Argos, a case exploring whether COVID-19 health concerns could justify refusal of light duty work, which the Court remanded for further fact-finding.
Lindsey Stewart practices in Constangy’s Atlanta and Macon offices, where she represents employers, insurers, and self-insured organizations in workers’ compensation defense matters, handling claims from initial filings through resolution.
