In the News: Frank Shuster Discusses Remote Worker Compensation Rules in HR Dive

Constangy partner Frank Shuster authored an article for HR Dive discussing how employers develop rules for determining and documenting when a remote employee’s workday begins and ends. 

Frank shared insight on the framework for separating compensable and noncompensable activities and the challenge of navigating the federal court system, as decisions from one appeals court are not binding on the courts in another circuit. He went on to address what employers should do to identify whether activities are compensable, considering that the rules differ depending on location. 

“That depends on where your employees live and work and your tolerance for risk,” said Frank. “But at a minimum, an employer should identify 1) the activities that are indispensable andintegral to its employees’ principal activities and 2) the activities that are preliminary and postliminary to them.”
