Overview

Rob Yang is a member of the Constangy Cyber Team and is based in the San Francisco office.  He is a member of Constangy cyber litigation team and defends clients in class action matters resulting from data privacy and security events. Rob brings several years of data privacy and cybersecurity litigation experience to the Constangy cyber litigation team.  This includes experience defending class actions alleging violations of various state and federal data privacy-related statutes, including the Wiretap Act, the Fair Credit Reporting Act (FCRA), and the California Invasion of Privacy Act (CIPA).  Rob also has substantial experience counseling clients on risk mitigation measures pertaining to these and other data privacy and security regulations, including the Illinois Biometric Information Privacy Act (BIPA) and the Telephone Consumer Protection Act (TCPA).  This involves assisting clients in responding to data security incidents, including facilitating forensics investigations and consumer and regulatory notification projects.  Rob has also advised cyber insurance carriers regarding cyber liability insurance coverage and risk management. 

Rob earned his Juris Doctor from the University of California, Hastings College of the Law, with a concentration in Intellectual Property Law. Prior to attending law school, Rob worked as an Engineer with the U.S. Army Corps of Engineers in San Francisco. He earned a Bachelor of Science degree in Civil Engineering from the University of California, Berkeley, and a Bachelor of Arts degree in Business Management and Economics from the University of California, Santa Cruz. Rob also holds the Certified Information Privacy Professional for United States laws (CIPP/US) credential from the International Associate of Privacy Professionals (IAPP).

Representative Matters

Representative Matters

  • Defended a pet food manufacturer against FCRA class action. Successfully obtained dismissal following a motion for judgment on the pleadings by arguing that Plaintiff lacked standing to maintain a FCRA claim in California state court. Assisted in the successful defense of the appeal of said dismissal. Navarro v. Schell & Kampeter, Inc., No. C098432, 2024 Cal. App. Unpub. LEXIS 1895 (Mar. 26, 2024).
  • Successfully defended a sales enablement software company against CIPA class action alleging "wiretapping" of pre-recorded sales calls. Successfully directly negotiated a dismissal of the matter with zero settlement dollars paid by the client.
  • Defending numerous companies in single claimant pre-litigation and arbitration matters against Wiretap Act and CIPA claims alleging website tracking technologies (e.g., Pixels or chatbots).
  • Spearheaded response to PHI breach involving a spear phishing attack against a medical provider that resulted in the disclosure of employee data. Assessed data security problem, coordinated with relevant vendors to facilitate forensic investigations, drafted breach notification letters to employees, prepared reports to HHS and the California Attorneys’ General Office.
