Deadline is February 2 this year.
Covered employers are required to file their federal EEO-1 Reports with the Secretary of the Commonwealth of Massachusetts. Employers are subject to this requirement if they
- Have 100 or more employees with a primary place of work in the Commonwealth, and
- Are required to file a federal EEO Report.
The Massachusetts filing deadline is February 2, and the filing portal is now live.
Under the Massachusetts statute, the filing deadline is February 1, and that is reflected on the filing portal. However, because February 1 is a Sunday, the Commonwealth has clarified that the deadline for this year is Monday, February 2.
Covered employers must submit their most recently filed EEO-1 Reports, which will be the Reports that covered the 2024 reporting cycle. Multi-state employers should file the EEO-1 Reports that cover Massachusetts establishments. Employers may elect to submit a copy of their consolidated report, headquarter report, or establishment report, as long as they cover all Massachusetts establishments.
Companies that are required file EEO-3, -4, or -5 Reports must submit those to the Commonwealth in alternating years. Because this is an even-numbered year, employers with an EEO-4 Report filing obligation must submit their Reports using the same portal. Employers who submit EEO-3 and -5 Reports must file those Reports with the Commonwealth in 2027.
As a reminder, employers with at least 25 Massachusetts employees must also disclose pay ranges in job postings and at the time an individual applies for a promotion or transfer, starts a new position, or requests the range for the current position. This requirement went into effect in October 2025.
