New Acting Director at OFCCP

And other changes are afoot. 

Michael Schloss has been named Acting Director and Deputy Director of Policy of the Office of Federal Contract Compliance Programs. Mr. Schloss previously served as Director of the Office of Field Administration at the U.S. Department of Labor’s Employee Benefits Security Administration. The EBSA is generally responsible for protecting employee benefit plans in the private sector and ensuring compliance with the Employee Retirement Income Security Act.

The former Director of the OFCCP, Michele Hodge, is now Deputy Director. The positions of Chief of Staff and Special Assistant to the Deputy Director are vacant, but other high-ranking OFCCP officials – such as Tina Williams (Director, Policy and Program Development) and Robert LaJeunesse (Director of Enforcement) – are still employed with the agency. The OFCCP does not list any job vacancies, consistent with the President’s freeze on federal hiring

The OFCCP has also made changes to its website in response to President Trump’s rescission of Executive Order 11246.The links to the Executive Order and its regulations are no longer available, and the following message is displayed on the agency’s homepage:

On January 21, 2025, the White House and President Donald Trump issued an Executive Order: "Ending Illegal Discrimination and Restoring Merit-Based Opportunity", which revoked Executive Order 11246. For 90 days from the date of this order, Federal contractors may continue to comply with the regulatory scheme in effect on January 20, 2025. Requirements under Section 503 of the Rehabilitation Act, 29 U.S.C. 793, and the Vietnam Era Veterans' Readjustment Assistance Act (VEVRAA), 38 U.S.C. 4212, both enforced by OFCCP, are statutory and remain in effect.

OFCCP is updating the website to bring the information into compliance with the new executive order. Please check back for updates and further guidance. Many contractors in the midst of an OFCCP compliance evaluation received a notice that the portion of the audit relating to Executive Order 11246 has been closed and that the component of the audit relating to Section 503 and VEVRAA has been held in abeyance pending further guidance. The Acting Secretary of Labor directed the OFCCP to send this communication.
