OFCCP announces new certification deadline 

Contractors, mark your calendars!

The Office of Federal Contract Compliance Programs announced that the Contractor Portal will open on March 31 and that contractors will have until June 29 to certify compliance. 

The procedures appear to be similar to last year when the Portal debuted, but contractors will also be required to "provide the start date of their AAP Coverage Period when certifying." The term "AAP Coverage Period" does not appear to be defined by the OFCCP yet, but presumably this refers to the AAP date. The OFCCP states that it will post a pre-recorded webinar by March 29, and its FAQs are still available. 

The OFCCP again warns that "[e]xisting contractors that have not certified by June 29, 2023, will be more likely to appear on OFCCP’s scheduling list than those that have certified their compliance with AAP requirements." In January, the OFCCP released a CSAL that included contractors that had not certified compliance last year, so this is not an idle threat.

Contractors should start planning now for the June 29 deadline to ensure that they can certify that AAPs have been developed and maintained as required. Contact a member of Constangy's Affirmative Action/OFCCP Compliance practice group with any questions.
