The U.S. Department of Homeland Security has sent for review a proposed rule (Weighted Selection Process for Registrants and Petitioners Seeking To File Cap-Subject H-1B Petitions) regarding the H-1B lottery selection process. After the Office of Management and Budget completes its review, the next step would be for the DHS to publish the proposed rule in the Federal Register to provide notice and allow for comments from the public. UPDATE (7/2/25): A federal judge in New York on Tuesday found that the U.S. Department of Homeland Security did not have the authority to partially vacate Haiti’s TPS status. According to Judge Brian Cogan (a George W. Bush appointee), it was unlawful for the DHS to have shortened the TPS designation period from its original expiration of February 3, 2026, to August 3, 2025. This decision could mean a return to the February 3, 2026, expiration date, but that could be temporary. We expect the DHS to appeal, and seek review by the U.S. Supreme Court if necessary.
